These Terms and Conditions (“Terms”) govern your use of the website at highlandsdispensary.com.au, the patient portal, and the products and services provided by [legal entity name] (ABN [ABN]), trading as Leyla Oxley Naturopathy and Highlands Dispensary (“we”, “us”, “our”).
By using the website, booking a consultation, or placing an order, you agree to these Terms. If you do not agree, please do not use our website or services. Our Privacy Policy forms part of these Terms.
We may update these Terms from time to time. The version published on our website at the time you use our services or place an order applies to that use or order.
To use our services you must be at least 18 years of age and located in Australia. Products are dispatched to Australian delivery addresses only.
Some services require an account, accessed by magic-link sign-in. You are responsible for keeping access to your email secure and for activity that occurs through your account. Please tell us promptly if you believe your account has been accessed without authorisation.
You agree to provide accurate and complete information and to keep it up to date, including the health information needed for safe care.
Consultations are provided by Leyla Oxley, a naturopath accredited with the Australian Traditional-Medicine Society (ATMS).
Nature of the service. Naturopathy is a form of complementary medicine. Our consultations, Protocols and Treatment Plans are intended to support your health and wellbeing. They are not a substitute for diagnosis, advice or treatment from a medical practitioner. We do not diagnose or treat medical conditions, and nothing we provide should be relied on as medical advice.
Mineral screening. Oligoscan and similar assessments are screening tools used to inform your care. They are not diagnostic tests and do not replace pathology or medical investigations.
Please consult your doctor. You should not stop, start or change any prescribed medication or medical treatment without speaking to your treating doctor. If you have a medical emergency, call 000.
No guarantee of outcomes. Health outcomes depend on many factors. We bring professional care and judgement to your treatment, but we cannot and do not guarantee any particular result.
Bookings, fees and cancellations. Consultation fees are as displayed at the time of booking (currently the Standard Consultation, 60 minutes, $200, and the OligoScan Consultation, 75 minutes, $335). After consultation, the practitioner may prepare a Protocol signed by Leyla Oxley. Where a product requires practitioner approval, access to purchase that product through the dispensary is unlocked only once the practitioner has signed off on the relevant Protocol. This step exists for your safety and to meet our professional and regulatory obligations; it is not merely an administrative step.
Your Protocol, Treatment Plan and supplement Stack are prepared specifically for you based on your circumstances. They are personal to you, should not be shared with or used by anyone else, and may not be suitable for another person.
Some products in our dispensary are finished, ready-made supplements supplied as ordinary retail products.
Orders. When you place an order you make an offer to purchase. A contract is formed when we accept your order, which we may do by confirming or dispatching it. We may decline or cancel an order, for example where a product is unavailable, where there is a pricing or description error, or where supplying it would not be appropriate for you.
Pricing. Prices are in Australian dollars and include GST unless stated otherwise. Delivery charges, if any, are shown before you complete your order.
Delivery. We will provide an estimated delivery timeframe. Estimates are not guarantees. Risk in the products passes to you on delivery.
Some products are practitioner-only formulations or are compounded specifically for you as a named patient, made to order based on the practitioner’s prescription.

Because compounded products are made to order for you specifically, they cannot be returned or refunded for change of mind. This does not affect your rights where a product fails to meet a consumer guarantee (see section I).
The Ongoing Support Program is a recurring subscription (currently $75 per month) that includes [program inclusions, as described at sign-up].
Recurring billing. By subscribing, you authorise us to charge your nominated payment method monthly until you cancel. The subscription automatically renews each billing period.
Cancellation. You can cancel at any time, effective at the end of your current billing period, through the portal or by contacting us. Unless required by law, fees already charged for the current period are not refunded.
Changes. We will give you reasonable notice of any change to the price or inclusions of the program, and you may cancel if you do not accept the change.
Payments are processed securely by our payment provider (Stripe). By paying, you agree to that provider’s terms in relation to the processing of your payment. You authorise us (and our payment provider) to charge the amounts due for your orders, consultations and subscriptions. Prices include GST where applicable, and a tax invoice is available on request.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Services must be provided with due care and skill and be fit for any purpose made known to us.
Change of mind. Outside your rights under the Australian Consumer Law, we are not required to provide a refund for change of mind. Compounded and made-to-order products cannot be returned for change of mind (see section F). [voluntary change-of-mind policy for finished products, if offered]
Faulty or incorrectly supplied products. If something is wrong with your order, contact us at [support email] with your order details and we will work with you to put it right in line with the Australian Consumer Law. For health and safety reasons, we generally cannot accept the return of supplements that have been opened or are no longer in their original condition, except where required by the Australian Consumer Law.
Products supplied through the dispensary are therapeutic goods and are supplied in the context of a practitioner relationship. Information on the website about products or conditions is general in nature, is not advertising directed at prescribing yourself, and is not a substitute for individual professional advice. Always read the label and follow the directions for use. If symptoms persist, talk to your health professional.
You must not rely on general content on the website to self-prescribe. The appropriateness of any product for you is a matter for the practitioner following consultation.

All content on the website, and the Protocols, Treatment Plans, document templates, branding and materials we produce, are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, non-transferable right to use the Protocol and Treatment Plan prepared for you for your own health purposes. You may not reproduce, distribute or commercialise our content or materials without our written permission.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
To the extent permitted by law, and subject to the paragraph above:
We may suspend or end your access to the website, portal or services if you breach these Terms, or where it is necessary for safety, professional or legal reasons. You may stop using our services at any time, subject to the subscription terms in section G.
Governing law. These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
Severability. If any part of these Terms is found to be unenforceable, the rest continues to apply.
Entire agreement. These Terms, together with our Privacy Policy and any terms presented at the point of booking or purchase, form the agreement between us.
